RE: The tariff classification of goggle straps from China

Dear Mr. Burt:

In your letter dated July 6, 2009, on behalf of Smith Sport Optics, you requested a tariff classification ruling. A sample of the goggle strap was submitted with your ruling request.

The strap is composed of narrow woven fabric containing elastomeric yarn and measures approximately 9 ½ inches long by 1 ¾ inches wide. The strap has plastic molded ends which are designed to be snapped directly to the frame of ski or snowboard goggles. The strap helps to secure the goggle to the face of the wearer.

The applicable subheading for the goggle strap will be 9003.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of frames and mountings for spectacles, goggles or the like. The rate of duty will be 2.5 percent.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
